Negligence Results in Death

After suffering a work-related ACL tear, our client underwent surgery using an allograft, which later failed and required a second procedure. Steps to minimize the risk of blood clot formation were not taken after the first surgery. In the days following the second surgery, he experienced shortness of breath and began coughing up blood — classic warning signs of deep vein thrombosis (DVT) and pulmonary embolism (PE). He sought care from a local physician, who failed to recognize the severity of his symptoms and advised only over-the-counter Mucinex. Tragically, our client died from a PE just 17 days after the second surgery. A claim was filed against both the surgeon and the physician for negligence. The case settled for $775,000.00.

Work Related Head Injury

Our client suffered a serious head injury at work after being struck by a retracting bed cover on a piece of equipment that had recently been repaired by the employer. The employer disputed the claim, citing a potential safety violation, but the case settled prior to hearing. The $2.8 million settlement included a Medicare Set-Aside and a lifetime annuity guaranteed for at least 15 years. With the settlement, our client was able to purchase a handicap-equipped vehicle, restoring a degree of mobility and independence.

Our client was a passenger in a vehicle involved in a multi-vehicle accident on Interstate 77 in Carroll County, which tragically resulted in the death of the driver.
